Although it may come as a surprise to some, Medicare, the U.S. government-run health insurance program for senior citizens and certain disabled persons, has directly and permanently changed the claims handling process for the liability insurance market.
Since its enactment in 2007, the mandatory Medicare reporting obligations of companies and liability insurers under U.S. federal law, known as “Section 111,” have been a source of frustration and confusion. An exciting recent development in CMS policy guidance has clarified exactly who must report, particularly in the context of the subscription market.
At this market briefing event, our speakers will explain insurers’ Section 111 obligations: who must report, when to report and what must be reported. Ms. Surcouf will offer suggested best practices under the Medicare laws to ensure that the obligations of insurers, their clients and their attorneys are met. She will also address the status of enforcement efforts by the Centers for Medicare and Medicaid Services (“CMS”), the U.S. administrative agency responsible for administering Medicare, against insurers for noncompliance with Section 111.

Allison M. Surcouf is a partner at Condon & Forsyth LLP and her practice focuses on litigation involving aviation and product liability issues, as well as general commercial and civil matters. As a litigator defending personal injury actions against airlines and their insurers, Ms. Surcouf is especially familiar with the impact of the Medicare laws on personal injury claims. She routinely advises air carriers and insurers on their obligations under the mandatory Medicare reporting laws and the Medicare Secondary Payer Act.
Fiona Hodgson-Wood is an Executive Loss Adjuster, Aviation Claims at Chubb, with over 30 years’ experience. Fiona has enjoyed many positions across the London Insurance market including technical and leadership roles working within both Lloyds and Company Underwriters, as a broker and also in Liability Claims for a Loss Adjustor. This unique experience also expands to operating across all sizes and complexities of airline and aerospace accounts, from individual insureds to Multi-National blue chip companies. This breadth of experience allows her to work directly with Insureds, brokers and service providers with far greater understanding to provide the best outcomes for clients
