Following the recent IUA virtual Market Briefing of 25 January 2021
(recording here – password: 8Rtu356A), we are very pleased to confirm the details of a follow-up session with Simon Cooper of Ince.

This session, structured in a Q&A format, will answer questions posed by IUA members regarding the landmark judgment of the Supreme Court and its implications for insurers, reinsurers and brokers.

We would like to welcome members to submit any questions to Tom Hughes at the earliest opportunity, in order for these to be compiled ahead of the event.

Based on the outstanding questions following our recent event, the following key topics will be addressed:

-          Reinsurance and aggregation
-          The drafting of general exclusions and the broader construction of insurance policies
-          How insurance policies will be construed in future following the ruling
-          The meaning of an ‘ordinary policyholder’
-          The interrelationship between proximate cause, the ‘but for’ test and concurrent causation
-          The impact of the ruling on insurance brokers
-          Expectations of the FCA and the potential for Damages for Late Payment of Claims
-          The risk of contagion – the impact of the ruling overseas
