Having been forcibly seized by pirates in the Gulf of Aden in January 2009, the case of the MV Longchamp raised an interesting question regarding the allowance to general average of ship-owner’s expenses incurred during ransom negotiations.
This market briefing will discuss the decision in the Longchamp concerning substituted expenses in general average and review the application of Rule F more generally, including the Bigham Clause and the 2016 York Antwerp Rules.
Our Speaker: Robert Tomlinson joined Richards Hogg Lindley in March 2009 after graduating from Birmingham University with a Bachelor Degree in Ancient History. He qualified as a Senior Associate of the Association of Average Adjusters in 2010 and completed secondments in both the Jakarta and Hong Kong offices of Richards Hogg Lindley in 2012 and 2014.
