Subject: This market briefing sets forth potential legal risks (and ways of minimizing such risks) in electronic transactions, storage of e-data and going paperless in both the USA and UK.

As businesses continue to shift to digital data and information systems, the legal environment for risks and liabilities related to the use of these data and systems technologies continues to evolve.

 

Some of the key issues and areas of law in flux include:

 

  • Data privacy and information security – are company internal practices and policies appropriate in light of risk profile and evolving compliance obligations?
  • Record retention and e-discovery – how are electronic documents and data bases dealt with?Are back-up systems taken into account?Are practices consistent across platforms and in line with current legal requirements?
  • Paperless commerce and cloud computing – where is the data, who owns it, which laws apply?

 

Vivian Polak is co-chair of the Information Technology and Intellectual Property Transactions Practice Group at Dewey & LeBoeuf and has worked with numerous US and UK insurers and reinsurers on a wide variety of information technology issues.

 

Matthew Howse heads up Dewey & LeBoeuf's Employment practice in London and advises numerous insurance sector clients on the full range of employment law and discrimination law issues. Matthew also advises on privacy law issues including providing data protection compliance advice, reviewing data protection and employee monitoring policies and advising on freedom of information and the law of confidentiality.

 

David Waldron is Co-Chair of the Litigation Department with responsibility for EMEA and Asia.  David is an experienced commercial disputes lawyer and is regularly engaged in large scale disputes with complex international e-discovery.
